Terms and Conditions of Sale

1. Purpose

These Terms and Conditions of Sale ("Terms") govern the website creation and maintenance services provided by Luca Trinchini, operating under the trade name ltrinchini.dev, to his clients.

Any order or payment implies full acceptance of these Terms.

2. Services Offered

Luca Trinchini provides the following services:

  • Website creation (Basic, Comfort, Premium, Custom packages)
  • Additional services (add-ons)
  • Monthly maintenance plans
  • Domain name management

The details of each offer are specified when the payment link or quotation is sent to the client.

3. Pricing and Payment

Prices are expressed in Canadian dollars (CAD) for clients located in Canada and in euros (EUR) for clients located in Europe.

Applicable taxes may be added depending on the client's jurisdiction.

Payments are processed online via Stripe, a secure payment processing platform.

The applicable prices are those displayed at the time of the order. Luca Trinchini reserves the right to modify prices at any time without affecting orders that have already been confirmed.

4. Payment Terms

Payment may be made in one of the following ways:

  • 50% deposit before the start of the project, with the remaining 50% due upon delivery
  • Full payment before the start of the project

Any payment not received within 30 days of the invoice date may result in suspension of work and suspension of ongoing services.

Late fees of 1.5% per month may be applied to overdue amounts.

The delivered website may be temporarily disabled in case of non-payment of the remaining balance after reminder.

5. Project Start

The project begins only after:

  • receipt of the deposit or full payment
  • receipt of all required materials from the client (texts, images, logo, and other information)

Any delay in providing the required materials will result in an equivalent delay in the delivery timeline. Delivery timelines are provided for informational purposes only.

6. Delivery and Revisions

Upon delivery of the website, the client has 7 days to report any content corrections. After this period, the website is considered accepted as delivered.

The project includes 3 cycles of minor revisions. Any additional modifications or requests outside the original scope will be billed at the hourly rate of 50 CAD.

7. Out-of-Scope Changes

Any request for additions or modifications not included in the initial offer will be subject to a separate quotation or billed at the applicable hourly rate.

8. Monthly Maintenance

Monthly Plan

Billed monthly. Cancellation is possible at any time with 30 days' notice, sent by email to [email protected].

Annual Plan

Billed once for 12 months, including 1 month free. The annual subscription cannot be canceled during the active period. No refunds will be issued for remaining months if the client decides to terminate early.

9. Domain Name Management

If the domain name is managed by Luca Trinchini (Option B), an annual fee of 50 CAD applies. If the service is terminated, a transfer fee of 75 CAD will be charged to return the domain to the client.

10. Content Responsibility

The client is solely responsible for:

  • the accuracy of the information provided
  • the legality of the content
  • the rights to use texts, images, and logos

Luca Trinchini cannot be held responsible for errors in the content provided by the client or for any direct or indirect consequences resulting from such errors. It is the client's responsibility to review and validate all content before the website goes live.

11. Third-Party Services

Luca Trinchini cannot be held responsible for interruptions or malfunctions related to third-party services such as:

  • hosting providers
  • domain registrars
  • SaaS platforms
  • external APIs or tools

12. Intellectual Property

The client guarantees that they possess all necessary rights to the content they provide. Luca Trinchini cannot be held responsible if copyrighted material belonging to third parties is used without authorization.

The client becomes the owner of the delivered website once the website has been delivered and full payment has been received. If the project was fully paid at the time of ordering, the transfer of ownership occurs upon delivery of the website.

Full access to the website, source code, project files, and any administrative credentials will be provided only after full payment of the project has been received.

Luca Trinchini reserves the right to display the project in his portfolio, case studies, and professional networks, unless the client explicitly requests otherwise.

13. Project Suspension or Abandonment

If the client fails to respond for a period of 30 days, the project may be considered suspended. Resuming the project at a later time may incur restart fees.

14. Refunds and Cancellation

Payments are non-refundable once work has started.

If the project is canceled before work begins, a full refund may be issued within 7 business days.

15. Limitation of Liability

Under no circumstances shall Luca Trinchini's liability exceed the total amount paid by the client for the project in question.

16. Disputes

In the event of a dispute, both parties agree to attempt to resolve the matter amicably first. If no agreement can be reached, the competent courts of the Province of Quebec (Canada) will have jurisdiction for Canadian clients, and the courts of the client's country of residence for European clients.
